1. Agreement to Terms These Terms of Service constitute a legally binding agreement made between you and Visualize Communications Inc. (“we,” “us,” “our”), concerning your access to and use of the https://www.wearevisualize.com/ website as well as any related services, including our SMS and email communication programs. You agree that by accessing the site or opting into our communications, you have read, understood, and agree to be bound by all of these Terms of Service.
2. Intellectual Property Rights Unless otherwise indicated, the website and its content, including source code, databases, functionality, software, text, photographs, and graphics (collectively, the “Content” ) are our proprietary property and are protected by copyright and trademark laws. The Content is provided for your information and personal use only.
3. User Representations By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you have the legal capacity and you agree to comply with these Terms of Service; and (3) you will not use the Site for any illegal or unauthorized purpose.
4. SMS and Email Program Terms By providing your phone number and/or email address and affirmatively opting in, you consent to receive communications from Visualize Communications Inc. for marketing and/or transactional purposes.
  • Consent and Opt-In: Your consent to receive messages is not a condition of any purchase. You provide express consent by either checking a designated box on our website contact form or on a third-party event registration form (e.g., Eventbrite). For SMS marketing, a double opt-in may be required where you must reply “YES” to a confirmation text.
  • Use Cases: We send two primary types of messages:
    1. Marketing & Promotions: Alerts about our services, special offers, and digital marketing tips.
    2. Event Notifications: Transactional reminders, confirmations, and updates about events you have registered for.
  • Message Frequency: Message frequency will vary. For marketing, you can expect up to 4 messages per month. For events, frequency depends on the event schedule.
  • Opt-Out: You can cancel the SMS service at any time. Just text “STOP” to the short code or number. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. To opt-out of emails, click the “Unsubscribe” link at the bottom of any email.
  • Help: If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at info@wearevisualize.com or (647) 824-3889.
  • Carriers: Carriers are not liable for delayed or undelivered messages.
  • Message and Data Rates: As always, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
5. Governing Law These Terms of Service and your use of the Site are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
